Riparian Rights are a form of real property, a part of land law in Illinois. The law gives EQUAL rights to the use of water to owners of riparian land, which is land that borders upon a watercourse. A riparian owner can insist that his rights be accommodated with other uses. The rights, embedded within each riparian parcel of land, include the right to recreate over the entire, "private" lake in Illinois. (IDNR pdf)

CARTER Caught Bragging Everything on the Sly!

Some Lake Co. Officials Conning Villages to Loot Recreational Lake Rights!!
Radical restrictions being unjustifiably and covertly imposed over ENTIRE lakes via (ab)use of state statute 65 ILCS 5/7-4-4, which states:

Sec. 7-4-4.  The corporate authorities in all municipalities have jurisdiction over all waters within or bordering upon the municipality, to the extent of 3 miles beyond the corporate limits, but not beyond the limits of the State. (Source: Laws 1961, p.576) www.ilga.gov

Recreational Lake Rights are in Jeopardy in Lake County Illinois

Lake County private lakes where a village ordinance is passed and the 3-mile-extension statute being used against unincorporated lake owners:
   * Cedar Lake - (village ordinance of 10 hp maximum)
   * Deep Lake - (recommendtion of 10 hp maximum)
   * Bangs Lake - (several village ordinances restricting lake use)
   * Round Lake - (attempted)
            11-29-05 Villages attempt to restrict unicorporated, Round Lake
            12-2-05 Rebuttal letter from unicorporated, Round Lake riparian
            County of Will vs. Naperville Case
   * Wooster Lake - (village ordinance of 5 mph maximum)

Illinois Supreme Court Declared
"..the owner of part of a lake bed has a right to the reasonable use and enjoyment of the ENTIRE lake surface..(Illinois) promotes rather than hinders the recreational use and enjoyment of lakes." (Beacham v. Lake Zurich Property Owners Assoc., 1988)

We need your help to stop this political agenda!  Without revised legislation, boating in Lake County will be seized by the government.  Please contact us at:
